This is the privacy statement of FAIRWAY – PARTNERS IN LAW AND MEDIATION, a private limited company (hereinafter FAIRWAY), with registered office at Grote Markt 14, 1800 Vilvoorde, and registered with the Crossroads Bank for Enterprises under number BE 0473.608.537.
This privacy statement provides information on, among other things, which personal data FAIRWAY processes, why FAIRWAY processes it, how FAIRWAY obtains it, how long FAIRWAY retains it and with whom FAIRWAY shares it.

1. Who is the data controller?
FAIRWAY (and any affiliated companies and/or legal successors), of which the individual lawyers form part, is the party responsible for the processing of personal data (the "controller").
FAIRWAY is a private limited company under Belgian law.
2. Which personal data does FAIRWAY process?
Personal data is any information relating to an identified or identifiable natural person.
FAIRWAY processes this personal data in the context of its activities and services (including the activities of lawyers and mediators). FAIRWAY obtains this data, among other ways, because you provide it directly to FAIRWAY, because third parties transmit it to FAIRWAY, or because it originates from public sources.
FAIRWAY processes, among others, the following personal data:
- Personal identification and contact details, including name, first name, title, telephone number, address details, email address, date of birth, place of birth, national register number, photographs, data on household composition, relationship information, language, …;
- Electronic identification and usage data, including the data collected when a connection is made to the WIFI network (IP address, device data, …) or when you communicate with our firm (communication history, information included in the email header, IP address, …);
- Identification data in the context of anti-money laundering legislation, including a copy of the identity card, …;
- Financial and insurance data, including bank account numbers, policy information, financial transactions, …;
- Professional information, including professional activity and title, CBE number, mandates, …;
- HR data, including the data provided in the context of a job application and professional activities and/or services for FAIRWAY, …;
- Visitor and attendance information, including number plates, information regarding attendance at events, image and audio material, …;
- Data provided via the website, including the data provided via the contact form;
- Data provided via the websites of third-party service providers;
- Data relating to the content of files, including agreements, settlements, authorisations, solvency data, authorisation information, image and audio material, …;
- Marketing data, such as information you have provided to us or that we have collected in the context of your registration for events, marketing material such as newsletters and alerts, attendance at meetings and events, including access to and details of visits to our offices, as well as dietary preferences;
- CCTV images.
FAIRWAY also processes special and/or sensitive personal data (see also Article 9 GDPR):
- Criminal record, offences or convictions;
- Data of persons under the age of 16;
- Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, and the processing of genetic data, data concerning health, data concerning a person's sex life or sexual orientation.
In addition to personal data, FAIRWAY may also collect data that does not relate to an identifiable person. Such non-personal data makes it impossible to identify an individual directly or indirectly, so that it may be used freely for various purposes, such as optimising and improving the website, improving the provision of services or refining publications.
3. How does FAIRWAY collect your personal data?
FAIRWAY collects this data in the following ways, among others:
- Because you have provided this data yourself, by email, via a contact form, on subscribing to a newsletter, etc.;
- Because this data was received from a third party;
- Because this data is already public;

4. For what purpose does FAIRWAY process personal data?
FAIRWAY processes your personal data for the following purposes:
- the performance of FAIRWAY's activities and services (legal services, mediator services or other services offered by FAIRWAY); Without being exhaustive, this includes, among other things:
- the provision of advice;
- assistance;
- representation;
- negotiations;
- judicial dispute resolution;
- alternative dispute resolution;
- administrative proceedings;

- maintaining contact with all parties to a case file (opposing parties, intermediaries, (legal) representatives, public services, counsel, …);
- general office administration (invoicing, accounting, audits, debt recovery, …);
- processing requests for information and services;
- supplier management;
- compliance with legal and regulatory obligations (e.g. anti-money laundering legislation);
- marketing purposes, including maintaining and strengthening relationships with contacts, including the sending of newsletters, invitations to events, …;
- providing information about changes to services and products;
- managing and securing access to our offices (CCTV images, …);
- handling job applications;

5. On what basis does FAIRWAY process personal data?
FAIRWAY processes personal data on the basis of one or more legal grounds (Article 6 GDPR), such as:
- consent;
- the performance of a contract with FAIRWAY (or the preparation thereof);
- compliance with a legal, regulatory or professional-conduct obligation;
- the protection of the vital interests of yourself or another natural person;
- the legitimate interests of FAIRWAY or of a third party.
These legitimate interests include, among others:
- the (internal) organisation and administration of FAIRWAY, including internal reporting;
- the handling of case files, including the establishment, exercise or defence of a legal claim;
- maintaining and strengthening relationships with contacts, including the sending of newsletters, invitations, …;
- the prevention and detection of fraud, abuse or unlawful use of our services;
- the enforcement of internal rules and policies;
- security;

6. Is your personal data transferred and who has access to your data?
6.1. FAIRWAY does not sell your data to third parties.
6.2. In the context of its activities and services, it is sometimes necessary to transfer personal data to other actors.
FAIRWAY may consequently disclose personal data to third parties who perform certain services on our behalf or with whom we collaborate, including:
- Processors acting on behalf of FAIRWAY, such as partners, suppliers, subcontractors and external service providers. This includes, among others, web hosting companies, software suppliers, event organisers, translation agencies, translation services, providers of electronic signature services and security systems;
- IT service providers that offer technical support for our systems and applications (such as general IT services, telecommunications services, …);
- External advisers (whether or not lawyers), where this is necessary and/or important for the provision of services or the protection of your interests and/or rights or those of FAIRWAY;
- Parties involved, such as opposing parties, contact persons, bailiffs, courts and tribunals, administrative bodies, notaries, insurance companies, court experts;
- Postal and courier services (BPOST, DHL, UPS, …), for the dispatch and delivery of documents, files, exhibits or other materials;
- Payment service providers, for receiving or making payments;
- Professional service providers, such as bookkeepers, accountants, insurance brokers and insurers, who advise and support FAIRWAY in the administrative, financial and insurance-related aspects of its operations;
- Digital platforms for the submission of legal documents, such as the Digital Platform for Lawyers (dp-a), e-Deposit, Regsol and JustRestart;
- Law enforcement and supervisory authorities, including the police and judicial authorities, where there is a legal obligation to do so;
- Other processors with whom a processing agreement has been concluded.
The list above is non-exhaustive. These may be domestic or foreign actors (see also 6.4.). FAIRWAY, however, only transfers data for the purposes mentioned in this privacy statement, and this on the basis of the legal grounds indicated above.
6.3. The personal data is, moreover, accessible to the lawyers, staff and personnel associated with FAIRWAY (whether or not of counsel) who need it for the performance of their tasks and assignments.
6.4. Some personal data may be stored or transferred outside the European Economic Area (EEA), for example via service providers established outside the EEA or whose servers are located outside the EEA. Such transfers take place in compliance with the applicable provisions set out in the GDPR.
7. What retention period does FAIRWAY observe?
FAIRWAY does not retain personal data for longer than is necessary for the purposes for which it was collected or further processed, taking into account, among other things, the nature of the relationship, the statutory retention periods and the legitimate interests.
FAIRWAY nevertheless reserves the right to retain and process personal data for a longer period if FAIRWAY is required to do so in the context of a legal or regulatory obligation, in the context of an ongoing dispute between you and FAIRWAY, or if the retention is justified by another legal ground.
8. Confidentiality and security
FAIRWAY has taken appropriate technical and organisational measures to protect the personal data against unauthorised or unlawful processing and against accidental loss, destruction or damage.
Under no circumstances can FAIRWAY, nor its auxiliaries, be held liable, whether contractually or non-contractually, for any direct or indirect damage resulting from the wrongful or unlawful use of the personal data by a third party.
9. What rights do you have?
In accordance with the applicable regulations and within the limits set therein (for example, professional secrecy or lawful processing), data subjects have the following rights with regard to the processing of data by FAIRWAY:
9.1. Right of access
You have the right to obtain confirmation as to whether or not personal data concerning you is being processed and, where applicable, to request from FAIRWAY a copy of the data referred to in Article 15 of the General Data Protection Regulation. If you request additional copies, we may charge you a reasonable fee.
9.2. Right to withdraw your consent
In cases where the processing of data is based on your consent, you have the right to withdraw it at any time. The withdrawal of consent does not, in any event, affect the lawfulness of the processing based on consent before its withdrawal.
9.3. Rectification and completion of data
You have the right to obtain the rectification of inaccurate personal data concerning you. In addition, you always have the right to request FAIRWAY to complete or erase your personal data. You acknowledge that, in the event of a refusal to communicate or a request to erase personal data, certain services may no longer be capable of being provided.
9.4. Right to erasure ("right to be forgotten")
You have the right to obtain the erasure of personal data concerning you where there is a legal basis for doing so (for example: the personal data is no longer necessary for the purposes for which it was collected or otherwise processed; the personal data has been unlawfully processed; …).
9.5. Right to restriction of processing
You have the right to obtain the restriction of the processing of personal data where there is a legal basis for doing so (for example: you contest the accuracy of the personal data; the processing is unlawful and you oppose the erasure of the personal data and instead request the restriction of its use; …).
9.6. Right to data portability
In certain cases, you have the right to receive the personal data concerning you, which you have provided to FAIRWAY, in a structured, commonly used and machine-readable format. In those cases, you also have the right to transmit that data to another controller.
9.7. Right to object
You have the right to object at any time to the processing of personal data concerning you on grounds relating to your particular situation, where:
- the processing is based on our legitimate interests or those of a third party, unless there are compelling legitimate grounds which override the interests, rights and freedoms of the data subject or which relate to the establishment, exercise or defence of a legal claim;
- the processing is carried out for the purposes of direct marketing.
You may exercise the aforementioned rights by contacting us for this purpose, either by email to privacy@fairway.law, by post to FAIRWAY, Grote Markt 14, 1800 Vilvoorde, or by using the "contact us" section on the website (www.fairway.law), enclosing a copy of your identity card.
You should bear in mind that FAIRWAY may not be obliged to comply with your request for access, correction, erasure or transfer. This may be due to legal obligations or legitimate interests, for the establishment, exercise or defence of a legal claim, for the legitimate exercise of the right to freedom of expression and/or information, or on the basis of another legal ground that FAIRWAY will always specify on request.

FAIRWAY reserves the right to amend or otherwise modify this statement.

12. Disputes
Any disputes regarding interpretation or any other disputes concerning the application of this privacy statement will first be discussed between the relevant parties. In doing so, all parties always strive for an amicable resolution of the dispute.
